VACATION RENTAL AGREEMENT

TERMS AND CONDITIONS

Thank you for choosing Incline Vacation Rentals to reserve your privately owned vacation home, condo, or cabin. Please take a moment to read and understand our Vacation Rental Agreement.

1. Check-in time is after 4:00 p.m. and check out time is 10:00 a.m. Pick up keys & directions to the property at our office. There will be an envelope with your name on it in the assigned mailbox next to our door. You will need to bring the directions to our office and your box with you. Please coordinate with other members of your party regarding keys. Return keys to our office upon departure. There is a drop slot next to the front door below the mailboxes. $25/KEY CHARGE FOR REGULAR PROPERTY KEYS NOT RETURNED. THERE IS A $150/ KEY CHARGE FOR 999 LAKESHORE GATE KEYS, POOL KEYS, BEACH KEYS, PARKING PERMITS, OR GARAGE DOOR OPENERS.

2. Cancellation policy: High Season: All reservations for condominiums at 999 Lakeshore Dr. , lakefront properties, and other properties on the lake side of Tahoe Blvd. must be canceled at least 90 days prior to arrival. If canceled less than 90 days prior to arrival, the full amount shall be forfeited. All 999 Lakeshore reservations will be required to pay a non-refundable $500 booking deposit. This will be applied to the rental charges. In the event the reservation is cancelled outside of the 90 days this will be NON-REFUNDABLE. All other cancellations in the high season must be made at least 60 days prior to arrival or the full amount will be forfeited. The high seasons run from June 16 th - September 15 th and November 18 th - April 1 st . Off season: Cancellations must be made a minimum of 14 days prior to arrival (30 days prior to arrival for 999 Lakeshore or lakefront units). ALL cancellations will be assessed a $50 cancellation fee. If you have taken the optional trip insurance and need to cancel inside the cancellation period due to a qualifying reason (see your policy), the insurance company will refund all but the trip insurance policy cost and the damage deposit directly to you. The damage deposit will be refunded by IVR.

3. Guests shall not have any pets on the premises. If evidence of pets is detected, additional charges WILL be incurred (minimum $200 for ozone and deflea treatment).

4. Smoking is prohibited in all properties. If evidence of smoking is detected, additional cleaning charges WILL be incurred. (Minimum $100 for ozone machine)

5. Guest shall not have more occupants than stated and shall not sublease the property at any time. If there are more guests than the property allows, guests will be evicted and all monies will be forfeited.

6. It is important for you to remember that these are private homes in the mountains, subject to severe weather conditions, and occasional power outages. Unlike hotels, we do not provide daily maid and towel service or 24 hour support except in absolute emergencies. Additional cleaning services can be arranged for a fee.

7. We do not require the owner of the property to provide firewood. Be aware that you may need to purchase or bring your own firewood.

8. Please bring your own beach towels. Do not take towels from the property to spas, pools, or beach.

9. We provide 2 rolls of toilet paper per bathroom. We do not provide cleaning supplies or laundry detergent.

10. Please be advised that the home you are renting may be located within a condominium or PUD association which contains certain amenities and common areas (including but not limited to the swimming pool, gym, elevators, sauna, alarm system, etc..) which may from time to time not be fully functional or operational or may be under repair and that the use of these areas and/or amenities may be unavailable or limited during your stay in the property. In this context, while we recognize and regret any resulting inconvenience to our guests, the owner will not be responsible for any such events of outage or unavailability and shall have no responsibility or obligation to grant any discount or refund of any of the rental fee as a result of any such circumstances.

11. Guests agree to assume responsibility for transportation to the property. Inconvenience caused by weather, disruption of utilities, or road conditions occur in snow and mountain country and do not invalidate this agreement, nor will they be subject to financial compensation. Guest acknowledges that they are traveling into mountain country and is advised to be prepared for changing weather conditions. During winter months, carry chains, shovel, flashlight, and extra blankets, food, and water.

12. All of our properties are located in residential areas and may not be used for weddings, receptions, or parties without specific permission. Failure to comply with local government and/or homeowner's associations regulations concerning trash, parking, loud or inappropriate behavior, and pets, could result in additional charges and/or fines or possible eviction with no refund.

13. Our homeowner = s beach privileges are available for your use. We will provide you with a form that allows you to purchase daily passes. Current rates for access to Incline Beach and Burnt Cedar Beach are $4/children and $8/adults, $14 for boat launching.

14. A phone is provided for your convenience. All long distance calls must be billed to your credit card or home phone unless the property is designated as one with unlimited free long distance.

15. All properties are privately owned and managed by Incline Vacation Rentals, Inc. at contracted rental rates. Guests agree to hold Incline Vacation Rentals, Inc. free and clear of any damage or injury to self or property resulting from accident, injury, or loss due to rain, snow, flood, negligence, fire, theft, or other reason.

16. Guests acknowledge that there will be no refund for early check-out, delayed check-in, health or family emergencies, weather conditions, inconvenience or dissatisfaction. In the event the guest is dissatisfied, Incline Vacation Rentals, Inc. = s sole responsibility will be to correct the problem as soon as practically possible, or to offer to move Guest to a comparable accommodation (if one is available), at the sole discretion of Incline Vacation Rentals, Inc., providing Guest notifies Incline Vacation Rentals, Inc. immediately. Incline Vacation Rentals, Inc. reserves the right to move reservation to a comparable unit, subject to availability to remedy conditions beyond its control.

17. Guests will be charged an extra day for checking out after 10:00 a.m. without prior approval.

18. This Security Deposit Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $3,000.00. Any damages that exceed $3,000.00 will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000.00. Certain terms and conditions apply. Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy. The Security Deposit Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Incline Vacation Rentals any amount payable under the terms and conditions of the Rental Unit Damage Protection. Please contact Incline Vacation Rentals directly if you do not wish to participate in this plan or assignment. If you choose not to participate in this plan, you will be charged a $1,000.00 refundable damage deposit.


DAMAGE DEPOSIT REFUNDS

Cleaning and Sanitizing each property is required upon departure. This is paid for with the cleaning charge included in your total accommodations. In the event of the need for more extensive cleaning (i.e. stains on carpet) or in case of damage to anything in the property or to the property itself, we have collected a damage deposit. You will be charged for damages in excess of the damage deposit For prompt refund of your damage deposit please comply with the following guidelines:

1. Our housekeeping staff will vacuum, do laundry, make beds and perform a complete inventory of the property following your departure. Any missing items, extraordinary cleaning, or damage to the property will be charged against your damage deposit. If a dump & scrub is needed in properties with private hot tubs, the minimum charge is $200. If there are damages exceeding the amount of your deposit, these will be charged to your credit card.

2. Load and start the dishwasher before leaving. All dishes, pots, pans, and utensils must be cleaned and put away.

3. Check to make sure all personal property is removed from property, especially things such as cell phone chargers and digital cameras. We cannot be responsible for items left in the property. Should you request the return of an item, there will be a $25 handling charge and the item(s) will be shipped C.O.D.

4. Bag and dispose of all trash inside appropriate receptacle. Please do not leave trash or coolers with food outside. Bears & other critters will get into it .

5. Replace all furniture in its original location. There is a minimum $25 charge for us to move the furnishings. There will be a minimum $50 charge if cables to TV's have been used for other electronic devices and not re-attached properly.
